Please read these Terms of Service carefully before using KhojMitra. These Terms govern your access to and use of the Platform and are compliant with applicable Indian law including the IT Act 2000, IT Rules 2021, and the DPDP Act 2023.
By accessing or using the KhojMitra website and mobile application ("Platform"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations of India. If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform. KhojMitra reserves the right to amend these Terms at any time; continued use after changes constitutes your acceptance of the revised Terms. The date of the most recent revision is indicated at the top of this page.
KhojMitra is an online local business discovery platform that helps users find businesses, shops, service providers, and other establishments in their area. The Platform aggregates business listing information from multiple sources including (a) direct submissions by business owners, and (b) publicly available third-party data sources such as government databases, business directories, and map services ("Third-Party Sourced Listings"). KhojMitra operates as an intermediary under the Information Technology Act, 2000 ("IT Act") and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules").
Some listings on KhojMitra are sourced from publicly available information and third-party data providers and may have been added without the direct knowledge of the business owner ("Third-Party Sourced Listings"). By displaying such publicly available information, KhojMitra does not claim ownership of, or any rights over, the business. KhojMitra makes no representation or warranty regarding the accuracy, completeness, or currency of Third-Party Sourced Listings. If you are a business owner and your business appears on our Platform without your authorisation, or if any information is inaccurate, you may: (a) Claim your listing by registering as a Business Owner and requesting ownership through our platform; (b) Request correction or update of inaccurate information by contacting us at [email protected]; or (c) Request removal of your listing by contacting our Grievance Officer at the details provided in Clause 17. We will process verified removal or correction requests within 15 business days.
KhojMitra is an intermediary as defined under Section 2(1)(w) of the IT Act. KhojMitra shall not be liable for any third-party information, data, or content hosted on the Platform as per Section 79 of the IT Act, provided that KhojMitra: (a) does not initiate, select the receiver of, or modify the third-party information; (b) observes due diligence as required under IT Rules; and (c) acts expeditiously upon receiving actual knowledge or government notification to remove or disable access to unlawful content. This safe harbour protection does not apply if KhojMitra has conspired, abetted, aided, or induced commission of an unlawful act.
You must be at least 18 years of age to use KhojMitra. Users between 13–17 years may use the Platform only with verifiable parental consent. By using the Platform you represent that you meet these requirements. You may sign in using your Google account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised account access at [email protected].
You agree not to: (a) post false, misleading, defamatory, obscene, or hate-speech content; (b) use the Platform for any unlawful purpose or in violation of applicable Indian law including the Indian Penal Code, IT Act, or Consumer Protection Act, 2019; (c) attempt to scrape, reverse-engineer, decompile, or disrupt the Platform or its servers; (d) impersonate any person, entity, or business; (e) submit spam reviews, fake ratings, or fraudulent business listings; (f) upload content that infringes any intellectual property, privacy, or other proprietary rights; or (g) engage in any activity that adversely affects other users' experience. Violation of these rules may result in immediate account suspension and legal action.
If you register as a Business Owner on KhojMitra, you represent and warrant that: (a) you are authorised to represent the business; (b) all information you provide is accurate, complete, and current; (c) you own or have the right to use any images, logos, or content you upload; (d) your business complies with all applicable laws and holds any required licences or permits. You agree to promptly update your listing if any information changes. KhojMitra reserves the right to suspend or remove listings that contain inaccurate, misleading, or policy-violating content. Listing on KhojMitra does not create any business relationship, partnership, or endorsement between you and KhojMitra.
Users may submit reviews, ratings, photos, and other content ("User Content"). By submitting User Content, you grant KhojMitra a non-exclusive, royalty-free, worldwide, irrevocable licence to store, display, modify, and distribute such content on the Platform. You retain ownership of your User Content. KhojMitra does not endorse User Content and is not responsible for its accuracy or legality. We reserve the right to remove User Content that violates these Terms or applicable law. False reviews submitted to harm a business, or fake positive reviews, may attract liability under the Consumer Protection Act, 2019 and IT Act.
All Platform content including the KhojMitra name, logo, software, design, and original editorial content are the intellectual property of KhojMitra and are protected under the Copyright Act, 1957 and Trade Marks Act, 1999. You may not reproduce, distribute, modify, or create derivative works of KhojMitra's proprietary content without prior written permission. Business names, logos, trademarks, and related information displayed on listings remain the property of their respective owners. Display of such information on KhojMitra does not constitute a claim of ownership.
KhojMitra aggregates information from multiple sources and cannot guarantee the accuracy, completeness, timeliness, or reliability of any listing. Business hours, contact details, services, and pricing may have changed since the listing was last updated. Users should independently verify critical information before visiting a business or making purchasing decisions. KhojMitra is not responsible for any loss or inconvenience arising from reliance on inaccurate listing information.
KhojMitra requests location access to show businesses near you and calculate distances. Location data is used solely on-device for proximity sorting and is not stored on our servers. Granting location permission is optional — the Platform continues to function using your manually selected city.
KhojMitra offers a paid "Boost" feature that allows verified business owners to have their listing displayed as a Sponsored result at the top of relevant search results for a chosen duration ("Sponsored Slot"). (a) Eligibility — Only business owners with an approved listing on KhojMitra may purchase a Sponsored Slot. (b) Pricing — Boost is priced on a per-day basis with volume slabs (longer durations attract lower per-day rates). The applicable pricing is displayed on the Boost page at the time of purchase. KhojMitra reserves the right to revise pricing at any time; changes will not affect already-paid or active slots. (c) Payment Method — Payment is accepted exclusively via UPI (Unified Payments Interface) to KhojMitra's registered UPI ID. After completing the UPI payment, you must submit your 12-digit UTR (Unique Transaction Reference) number and optionally a payment screenshot through the Boost form for manual verification. (d) Verification & Activation — KhojMitra will verify the submitted UTR against the received payment within 24 hours of submission. Upon successful verification, the Sponsored Slot will be activated for the selected date range. KhojMitra reserves the right to reject a submission if the UTR is invalid, the payment amount is incorrect, or if fraud is suspected. (e) One Active Slot — Only one active or pending Sponsored Slot is permitted per business at any time. You may submit a new boost request once the existing slot expires. (f) Slot Display — KhojMitra does not guarantee a specific number of impressions, clicks, or leads from a Sponsored Slot. Placement priority among multiple sponsored listings may vary based on relevance and other internal factors.
(a) All payments made to KhojMitra for Boost / Sponsored Listings are in Indian Rupees (INR) via UPI. (b) No Automated Recurring Billing — KhojMitra does not store your bank, card, or UPI credentials. Each boost is a one-time, manually initiated payment. There is no auto-renewal or subscription. (c) Refund Policy: • Full Refund — If KhojMitra is unable to verify or activate your Sponsored Slot within 48 hours of UTR submission due to reasons on KhojMitra's end, you are entitled to a full refund of the paid amount. • No Refund After Activation — Once your Sponsored Slot is verified and activated, no refund will be issued for any unused days, as the service has commenced. • Incorrect Payment — If you paid an incorrect amount, contact us immediately at [email protected]. Overpayments will be refunded; underpayments will require a top-up before activation. • Fraud / Disputed UTR — If a submitted UTR is found to be fraudulent or belongs to a cancelled transaction, your boost request will be rejected and the account may be suspended. (d) Refund Process — Approved refunds will be processed back to the originating UPI account within 5–7 business days. KhojMitra is not responsible for delays caused by your bank or UPI service provider. (e) Taxes — The prices displayed are inclusive of applicable taxes unless stated otherwise. If GST or any other statutory levy becomes applicable to KhojMitra's services in the future, it will be communicated to users in advance. (f) Disputes — For any payment dispute, contact [email protected] with your UTR number, payment screenshot, and business name. Unresolved disputes may be escalated to the Grievance Officer (Clause 17) or the appropriate consumer forum under the Consumer Protection Act, 2019.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. KhojMitra does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or harmful components. Use of the Platform is entirely at your own risk.
To the fullest extent permitted by applicable Indian law, KhojMitra, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, data, goodwill, or business opportunities, arising from: (a) your use of or inability to use the Platform; (b) reliance on any business listing or review; (c) unauthorised access to your account; or (d) any third-party conduct on the Platform. KhojMitra's total aggregate liability shall not exceed INR 1,000 (Rupees One Thousand Only).
The Platform may contain links to external websites or services operated by third parties. KhojMitra has no control over and assumes no responsibility for the content, privacy practices, or availability of third-party sites. Inclusion of a link does not constitute endorsement. You access third-party sites at your own risk.
KhojMitra may suspend or terminate your account, with or without notice, if you breach these Terms, engage in fraudulent or unlawful activity, or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) shall continue to apply.
In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, KhojMitra has appointed a Grievance Officer to address complaints and grievances: Grievance Officer: [Name] Designation: Grievance Officer, KhojMitra Email: [email protected] Working Hours: Monday–Friday, 10:00 AM – 6:00 PM IST Complaints must be acknowledged within 24 hours and resolved within 15 days of receipt. If you are a business owner seeking listing removal or correction, please email [email protected] with your business name, location, contact number, and proof of ownership.
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Before initiating any formal legal proceeding, the parties agree to attempt resolution through good-faith negotiations. If unresolved within 30 days, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Ahmedabad, Gujarat. The language of arbitration shall be English or Gujarati. Subject to the foregoing arbitration clause, both parties submit to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat, India for injunctive or other interim relief.
KhojMitra complies with applicable Indian legislation including: (a) Information Technology Act, 2000 and its amendments; (b) Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021; (c) Digital Personal Data Protection Act, 2023 ("DPDP Act"); (d) Consumer Protection Act, 2019; (e) Copyright Act, 1957; and (f) Trade Marks Act, 1999. In the event of conflict between these Terms and applicable law, applicable law shall prevail to the extent of such conflict.
